Asbestos exposure is a serious issue; some don’t realize the extent of the danger until they are diagnosed with mesothelioma. If you or someone you know has received such a diagnosis, it is crucial to retain the most skilled mesothelioma lawyer you can find, even if you must look out of state. Specialization is crucial in these types of cases.

Do you live in another state, but know of a highly experienced Illinois mesothelioma attorney? It’s best to trust the specialist in spite of the inconvenience; the benefit of that experience may be the difference between winning and losing.

Some people don’t realize they may be subject to a statute of limitations from the time of the mesothelioma diagnosis. A good mesothelioma attorney knows time is of the essence. You need to act quickly to begin legal proceedings, and the attorney will determine the strengths or weaknesses of your specific case. Unfortunately there are no standardized time limits; every state has different rules and regulations covering when and how you may file a lawsuit on the basis of asbestos exposure and mesothelioma diagnosis. There are factors which can influence your case—the type and duration of your exposure to asbestos, the laws of your state as they apply to occupational health hazards and legal claims against companies in violation of the applicable laws.

Mesothelioma attorneys need as much documentation and evidence as you can provide on your case. When you go to your first meeting, you may not be asked to bring all your medical and insurance records, but it is important to begin collecting this mesothelioma information as quickly as possible to avoid delays. No detail is too small; let your mesothelioma lawyer decide what is important and what is not. This is another reason why having a specialist in asbestos exposure cases is so important—those who take these cases on a regular basis already know the required paperwork, procedures and potential red tape associated with asbestos cases.

Mesothelioma lawyers can also help the surviving families of those who died as a result of asbestos exposure. If you have a loved one who died with a mesothelioma diagnosis in their medical records, you may be entitled to file a wrongful death lawsuit. Don’t let a lack of information cheat you out of the compensation you may be entitled to—consult a Chicago mesothelioma attorney or the closest mesothelioma lawyer you can find to learn what your rights are and how you should proceed.

Always consult a qualified lawyer, and never assume you don’t have a case. A trained lawyer should examine the facts and tell you whether those facts add up to a justifiable mesothelioma lawsuit.

The last I heard, the mesothelioma fund bill (S. 852) is on hold til the beginning of the year. And then we’ll have to see if all of the republicans are still on board. Some quotes to the press seem to show that they are beginning to realize how bad the bill would actually be for victims AND that there’s a good chance the fund would go bankrupt very quickly. We’ll see what happens when the Senate reconvenes in January.

According to recent research at NYU’s medical center, a protein in the blood called osteopontin may aid in early detection of mesothelioma…

In order to evaluate osteopontin as a potential marker for mesothelioma, researchers from several institutions conducted a clinical study to compare osteopontin levels in patients diagnosed with mesothelioma and patients with benign (non-cancerous) lung conditions. This study included 76 patients who had been diagnosed with mesothelioma, 69 individuals who had asbestos-related benign lung conditions and 45 healthy individuals who had not been exposed to asbestos. All individuals had their blood drawn and tested for osteopontin levels….Osteopontin levels were significantly higher in the group of patients diagnosed with mesothelioma compared to those individuals with asbestos-related lung complications

(article here)

Most people don’t detect mesothelioma until later stages - when it is too late for surgery. Better early detection techniques such as this would help immensely in treating people early on in the disease.

The insurance companies had tried to persuade the court they should not have to pay compensation to people with the condition. But those diagnosed with pleural plaques are at a far greater risk of contracting one of the many terminal illnesses associated with asbestos, such as mesothelioma, a terminal cancer of the lining of the lungs. They say the plaques cause acute anxiety, and feel they are living with a “timebomb”.

After this peak, the mortality rate is expected to fall rapidly to a background level, depending on what residual exposure to asbestos, if any, still persists.

I wonder why the are predicting the “rapid fall”. There are so many factors involves in how long it takes for mesothelioma to actually show up, I don’t know how they could predict something like that.
